Advisory

MGP’s partners have conducted document reviews, rendered advice and prepared agreements for employers, developers, contractors and subcontractors, vendors, purchasers and tenants on many aspects involved with commercial, retail and residential construction projects.

Dispute Resolution, Litigation & ADR

  • We are representing a subsequent purchaser at the Federal Court in respect of a land dispute involving the interpretation of sections 340 (2) & (3) of the National Land Code 1965. On 8.12.2016, the Federal Court granted leave to the subsequent purchaser to appeal to the Federal Court.
  • We are representing a construction & engineering company at the Court of Appeal in respect of an injunction to restrain the presentation of a winding-up petition (commonly known as a Fortuna Injunction) against a bona fide disputed debt.
  • We are representing one of seven (7) Appellant’s at the Court of Appeal, in respect of certain disputes arising out of the mismanagement of funds allocated to an Orang Asli Community.
  • We are representing a property consultant at the Court of Appeal, in respect of a dispute involving the development of a mixed commercial development in Johor Bahru, with a total GDV of approximately RM139 million.
  • We are representing a liquidator in respect of a suit commenced by a former shareholder of the company (in liquidation), with respect to the financial management of the company.
  • Represented a construction company in successfully enforcing an adjudication decision under the Construction Industry Payment and Adjudication Act 2012 (“CIPAA”) and defending a setting aside application at the Shah Alam High Court.
  • Represented the Main Contractor in civil proceedings commenced against the Sub-Contractor for road works project in East Malaysia;
  • Represented the Developer in civil proceedings against the buyer in respect of disputes surrounding the sale and purchase agreement; and

Arbitration

MGP’s partners’ arbitration experience includes:

  • Acted for the Property Manager of high-rise development in a UNCITRAL Arbitration Rules (as adopted by the Kuala Lumpur Regional Centre for Arbitration – “KLRCA”) arbitration with the Developer arising from a Property Management Agreement.
  • Acted for the Main Contractor in an International Chamber of Commerce (“ICC”) arbitration, seated in Singapore in respect of disputes arising out of the construction of a highway project;
  • Acted for a joint venture partner in an ad-hoc arbitration seated India against the other two joint venture partners arising from the proposed development of an oil & gas field off the coast of India;
  • Acted for the Sub-Contractor in a UNCITRAL Arbitration Rules (as adopted by the KLRCA) in an international arbitration seated in Malaysia, in respect of disputes arising out of the construction of a five-star hotel in the heart of Kuala Lumpur;
  • Acted for the Employer in respect of disputes arising out of the design and building of package 4, superstructure works of the administrative capital, Putrajaya, Malaysia; and
  • Acted for the joint venture partner in an ad-hoc arbitration against the specialised sub-contractor for the execution and completion of the chill waterworks system and certain infrastructure works at the Kuala Lumpur International Airport, Malaysia;
